Does the option directly or indirectly affect workers' existing rights and obligations, in particular as regards information and consultation within their undertaking and protection against dismissal?[1]
Definition
The European social dialogue is an indispensable component of the European social model, with a clearly defined basis in the EC Treaty. It refers to the discussions, consultations, negotiations and the joint actions undertaken by the social partner organisations representing the two sides of industry (management and labour). At European level, social dialogue takes two main forms - a bipartite dialogue between the European employers and trade union organisations, and a tripartite dialogue involving interaction between the social partners and the public authorities. In the context of Impact Assessment, it is of particular importance to assess the extent to which social dialogue is strengthen or under threat. This is of particular importance when large layoffs or industry restructiring are expected as a consequence of the proposal or when discriminatory practices may occur. Apart from reducing the risk of social exclusion, increasing this kind of protection also complies with with the economic objective of improving the functioning of labour market mechanisms. As a matter of fact, discriminatory hiring and dismissal conditions prevent effective allocation of resources according to the quantity and quality of skills offered and supplied, distorts price signals and undermine productivity growth. Regulatory measures can be designed in order to reduce the use of such practices.[1]
